1. Data controller
- Controller
- Techfuse S.L. (trade name: Ontech Marine)
- Address
- C/ Isidoro Antillón, 79 - 3, 07005 Palma, Illes Balears, Spain
We process personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on data protection and digital rights (LOPDGDD).
2. What data we collect
Through the contact form and the form in our website assistant we collect the data you enter:
- Name and email address (required)
- Phone number (optional, contact form only)
- Vessel name or length
- Port or location
- Service of interest
- The content of your message
The website assistant does not use artificial intelligence and does not store your conversation: only the data you send through its form reaches us. If you write to us by email, we process the data you send in that message in the same way and for the same purposes.
In addition, when you visit the website, our hosting provider (Netlify) automatically processes the technical data needed to deliver the site and keep it secure, such as your IP address, the date and time of the request, the pages requested and information about your browser and device (server logs). We do not use this data to identify you.
3. Purpose
We use the data you send us through the forms or by email to answer your enquiry and to prepare quotations for the work you ask about. The technical data of the hosting provider is used only to deliver the website and keep it secure. We do not use your data for any other purpose.
4. Legal basis
The legal basis is your consent (Article 6.1.a GDPR), which you give by ticking the Privacy Policy box before sending the form. You can withdraw it at any time by writing to us; withdrawing consent does not affect the lawfulness of the processing carried out before. The processing of technical data by our hosting provider is based on our legitimate interest in delivering and securing the website (Article 6.1.f GDPR).
5. Retention
We keep your data for as long as needed to handle your enquiry and, if a commercial relationship follows, for as long as that relationship lasts. After that, we keep it blocked for the periods required by law to deal with possible liabilities, and then delete it. Technical logs are kept by the hosting provider only for the period set in its own terms.
6. Recipients and service providers
We do not sell your data. We share it only with the service providers that process it on our behalf:
- Netlify (Netlify, Inc.), which hosts and delivers this website and provides the contact form (Netlify Forms): it receives what you enter in the form, stores it on its platform and sends it to us by email.
- Web3Forms (operated by Web3Creative), which receives what you enter in the website assistant's form and forwards it to us by email.
- Google Workspace (Google), which provides our email, where we receive and store the notifications of both forms and your messages.
Netlify, Web3Forms and Google act as data processors on our behalf (Article 28 GDPR): they process the data only to provide their service and following our instructions, under data processing agreements. They may use sub-processors of their own, which they publish in their respective terms.
We may also disclose data to public authorities when the law requires it.
7. International transfers
Our service providers may process data outside the European Economic Area, mainly in the United States. In each case the transfer is covered by appropriate safeguards under Chapter V of the GDPR.
Netlify, Inc. is based in the United States and delivers websites through servers in several countries. Transfers are governed by its Data Processing Addendum, which incorporates the European Commission's standard contractual clauses.
Google may process data outside the European Economic Area, including in the United States. Google provides safeguards for these transfers through its data processing terms, which include the European Commission's standard contractual clauses, and through the EU-US Data Privacy Framework.
Web3Forms is operated by Web3Creative (India) and its servers are located in the United States (US-East). Transfers outside the EEA are governed by its Data Processing Agreement.
You can ask us for information about these safeguards by writing to info@ontechmarine.com.
8. Your rights
You can exercise your rights of access, rectification, erasure, restriction of processing, data portability and objection by emailing info@ontechmarine.com, stating which right you wish to exercise. You do not need to attach a copy of your ID document. We will reply within one month.
9. Right to complain
If you consider that your data has not been processed correctly, you have the right to lodge a complaint with the Spanish Data Protection Agency (AEPD), www.aepd.es.
10. Changes to this policy
We may update this policy to reflect changes in the law or in how this website works. The date of the latest update is shown at the top of this page.
